This is a draft, not yet read by a lawyer. Parts of it may change before it is final.
Draft written by Etroy, to be read by a lawyer before it is final. Text in [square brackets] is still to be filled in.
1. Who we are
Etroy Growth is a service of Etroy Business Solution ("Etroy", "we"), 1143/A, Bashundhara Riverview, Hasnabad, South Keraniganj, Dhaka, Bangladesh. It is offered at https://etroygrowth.etroybd.com. You can reach us at etroybusinesssolution@gmail.com.
2. What the service does
- SEO: it reads the public pages of the websites a business adds and reports what could be better for search engines; shows page speed as measured by Google PageSpeed Insights; shows, when the business connects its Google Search Console, how people find the website on Google; and tells the business when its score drops or its website stops answering.
- Leads and follow-up: a list of the people who contact the business, with their history, tasks, reminders, follow-up emails and a booking page.
- A chat on the business's website or on a page of its own, which asks the business's questions and takes the visitor's contact details.
- AI, when the business turns it on and sets a monthly limit: SEO suggestions, keyword and blog ideas, drafts of the knowledge base and of emails, and the chat's answers from the knowledge base the business approved.
Every number the service shows comes from a named source: the website itself, Google, or the service's own records. Where there is no number yet, the service says so. Suggestions are suggestions: deciding what to change on your website is yours.
3. Workspaces and accounts
- A business uses the service through a workspace. The workspace's owner invites the people who work in it and decides their roles.
- Each person has their own account. Keep your password to yourself; we recommend two-step sign-in. Tell us at once if you think someone else has used your account.
- The business is responsible for what is done in its workspace by the people it let in.
4. Websites you add
- Add only websites that you own or are allowed to manage. Before the service reads a website, you prove it is yours (a tag on the site, a DNS record, or the connector on your own website).
- Our crawler reads public pages only, follows the website's robots.txt and keeps a slow pace. It names itself and points to a page that explains it (/bot).
- When you connect Google Search Console or Google Calendar, you give the service only the access it asks for. You can disconnect at any time; the access is then given back to Google.
5. Your customers' data
The leads, chats, bookings and emails in your workspace are about your customers. You are responsible for them:
- collect and use them lawfully, and tell your website's visitors how you do it (for example in your own privacy policy);
- email a lead only when the service lets you: with their consent, or in answer to their own request; and never after they asked for no more;
- answer your customers when they ask to see or delete what you hold about them. The service lets you export and delete it.
Etroy handles this data only on your behalf, to provide the service, as our Privacy Policy describes.
6. The AI
- AI can be wrong. Its suggestions, ideas and drafts are shown to a person, who decides; nothing it writes is sent or published by itself.
- The chat's AI answers your visitors by itself, but only from the knowledge base entries you approved, and offers a person when it does not know. What those entries say, prices and promises included, is yours to keep right.
- The AI costs money for each use. You set a monthly limit in taka; the service never passes it, and the AI pauses when it is reached. [How the AI's cost is charged to the business is agreed with Etroy until prices are added; see section 8.]
- If Etroy allows your workspace to use its own AI key, the AI service bills you directly under its own terms, and you are responsible for that account and its key.
7. Acceptable use
Do not use the service to read websites that are not yours, to send messages people did not ask for, to try to reach other workspaces' data, to overload or break the service, or for anything unlawful.
8. Prices
[The service is being set up with its first clients. Prices, payment and a refund policy will be added here before any payment is asked for. Until then, what a client pays, if anything, is agreed with Etroy in writing.]
9. Availability and changes
We work to keep the service running and backed up every night, but cannot promise it will never be unavailable. We may change or end features; we tell workspace owners before a change that takes something away from them.
10. Limits of our responsibility
[To be written with a lawyer: the service's reports and the AI's output are information, not a promise of search rankings, visitors or sales; the limit of Etroy's liability; what is excluded.]
11. Ending
A workspace owner may stop using the service at any time, download the workspace's data and ask us to delete it. We may suspend an account or workspace that breaks these Terms, and tell its owner why.
12. Changes to these Terms
When these Terms change, the version number above changes, and everybody using the service is asked to accept the new version before going on.
13. Law
[To be confirmed with a lawyer: these Terms are governed by the laws of Bangladesh, and disputes are settled by the courts of Dhaka.]
